KNM Secures Directed Verdict in Kansas

Kansas City Office’s Derek MacKay, and Andrew Serrone recently secured a directed verdict win on behalf of two clients, the owners of a Kansas-based logistics company.  Plaintiff demanded more than $3,000,000 in damages resulting from a co-defendant’s breach of fiduciary duty.  Plaintiff, a competing Kansas-based logistics company, alleged KNM’s clients tortiously interfered with Plaintiff’s existing business when it hired co-defendant.  Plaintiff’s lawsuit alleged multiple causes of action, but KNM was able to eliminate all but one claim of civil conspiracy prior to trial.  

At the close of Plaintiff’s evidence at trial, KNM filed a motion for directed verdict based on Plaintiff failing to meet certain requirements to bring a civil conspiracy claim under Kansas law. The District Court of Johnson County, Kansas agreed and sustained the motion for directed verdict dismissing them from the case.
