Defense verdict in Kalispell, Montana, in case alleging asbestos and creosote exposure by former engineer for the Great Northern Railroad. The Plaintiff claimed exposure to asbestos and creosote when operating a vintage “fireless locomotive” from 1969 to 1985 and working at a tie treating plant in Somers, Montana. The trial team led by Chad Knight through an aggressive motion practice obtained dismissal of the creosote exposure claim prior to trial. At trial, Chad proved to the jury that Great Northern was a safety-conscious company that protected its employees from known risks, and the plaintiff was never in a position that would have been identified as a risk for asbestos. A comprehensive presentation of the medical evidence in the case also showed the jury that the plaintiff did not have an asbestos-related disease. The jury returned a defense verdict.
