Killian Walsh secured a victory for an insurance client via a Motion to Dismiss on a claim against a landlord for a dog bite caused by a tenant’s dog. The Court agreed with KNM’s argument that the applicable precedent precluded recovery against a landlord for injuries caused by one of its tenants’ dogs. The Trial Court extended the Court of Appeals’ decision to hold that no one but an owner, possessor, keeper or harborer of an animal can be held liable for the animal’s actions and the insured, as a landlord, was not a possessor, harborer, owner or keeper of the dog at issue and could not be held liable for the injuries caused by the dog.
