Erik H. Nelson secured a dismissal for his client by arguing that the lawsuit was barred by res judicata, as the plaintiff had previously filed claims against the client's company, resulting in a dismissal, and subsequently filed a second lawsuit against the co-owner, which was dismissed with prejudice by the Court.

Court Grants Motion to Dismiss

Erik H. Nelson recently obtained a dismissal for his client when the Court granted his Motion to Dismiss.  Nelson had previously secured the dismissal of the same plaintiff’s claims against his client’s company after which plaintiff filed a second lawsuit against the co-owner of the company.  The Court agreed with his argument that the lawsuit was barred by res judicata or claim preclusion and dismissed the lawsuit with prejudice.
