Ben has tried multiple jury and bench trials to verdict, successfully defending his clients in complex tort and wrongful death cases, real property lawsuits, products liability lawsuits, and both first-party and third-party insurance litigation. He also has represented corporations in various tort claims, wrongful termination lawsuits, and other compliance matters.

Ben, a native to Montana, contributes to the future of his profession through involvement with the State Bar Technology Committee. The committee influences how attorneys in Montana use developing technology to present their cases in court, to analyze problems, to run their offices, as well as establishing security requirements for sensitive data.

Among his recent cases:

  • Ben successfully defended an elementary school teacher sued for wrongful death. She hit an animal while driving to work; a later driver swerved to miss the carcass of that animal, rolled her vehicle, and died. Through Ben’s work to present the case in a relatable way to the jury, he achieved an 11-1 defense verdict and helped prevent a new precedent from being set in Montana that would have put every Montana driver at risk of potential liability for common-place incidents with wild animals.
